Eimer Stahl represents LG Display in a multi-billion dollar antitrust case brought by Motorola Mobility, in which it is alleged that LG Display and other Korean, Japanese, and Taiwanese manufacturers agreed to fix prices of TFT-LCD panels that were sold to Motorola’s Asian subsidiaries and later incorporated into Motorola phones.  After the case was remanded from an MDL proceeding, during which a motion for partial summary judgment based on the Foreign Trade Antitrust Improvements Act ("FTAIA") was denied, the district court where the case may be tried granted reconsideration and entered partial summary judgment based on the FTAIA against Motorola as to 99% of the sales that are the subject of its claim.  Motorola then petitioned the Seventh Circuit Court of Appeals to permit an interlocutory appeal of the partial summary judgment decision.  The Court of Appeals granted interlocutory appeal, affirmed the entry of partial summary judgment, and denied Motorola’s subsequent petition for rehearing en banc.  Eimer Stahl has represented LG Display in connection with post-remand proceedings in the district court and the appeal.
