Joan Radovich is of counsel at Eimer Stahl LLP and primarily represents clients in environmental, products liability, and toxic torts litigation.  She also has complex commercial litigation experience.  Before joining Eimer Stahl, Ms. Radovich was an associate at Sidley Austin LLP in Chicago.  In addition to litigating cases at Sidley, she also counseled clients on a range of environmental regulatory matters.

Highlighted Cases

  • In re MTBE Products Liability Litigation – multidistrict litigation pending in the Southern District of New York.  The litigation arises out of groundwater contamination allegedly caused by Methyl Tertiary Butyl Ether ("MTBE"), a blending component formerly used in gasoline.   
  • New Hampshire v. Hess, et al. – environmental and product liability action brought by the State, acting in its capacity as parens patriae, relating to the use of MTBE in gasoline.
  • Fox River PCB Litigation – multidistrict Superfund action in Wisconsin to allocate liability for the largest environmental dredging project ever proposed in the United States.
  • Chlorinated Solvents Litigation – multi-defendant federal class action and individual suits alleging property damage and personal injury in connection with groundwater contamination from an industrial park in suburban Chicago.

  • Indemnity Arbitration – defended a food company in an arbitration relating to buyer/seller contract disputes over Clean Air Act compliance at a can manufacturing facility in Alabama.
  • Multi-Media Enforcement Action – defended a beef producer in a federal multi-media enforcement action in Nebraska, with an emphasis on Clean Water Act issues.
  • Bankruptcy Settlements – negotiated and drafted settlements of environmental bankruptcy claims on behalf of a paperboard manufacturer in a Chapter 11 proceeding.
  • Regulatory Compliance Counseling – advised clients on a range of compliance issues, including site remediation, permit transfer, financial assurance, federal civil penalty policies, local and state asbestos regulations, and wetlands permitting.
