In this matter, Eimer Stahl obtained dismissal for its client, Schreiber Foods, Inc., one of the largest dairy companies in the United States, in a multidistrict action alleging that our client conspired to artificially inflate the price of cheese and milk and to manipulate the price of milk futures contracts.  The matter raised multiple complex legal issues under the Sherman Act and the Commodity Exchange Act.  Eimer Stahl took the primary role in all aspects of the litigation, which involved dispositive motions, extensive discovery, and testimony from expert economists.  On August 18, 2014, the district court granted summary judgment in Schreiber’s favor on the merits of all claims, ruling that the plaintiffs had failed to produce sufficient evidence that Schreiber participated in the alleged conspiracy or independently manipulated milk futures contracts.  Eimer Stahl took an aggressive approach in the litigation, moving for summary judgment on Schreiber’s behalf on all claims before class certification and before the completion of discovery.  This strategy dramatically reduced the length and expense typically associated with a complex multidistrict antitrust class action of this nature.
