Eimer Stahl represents Land O'Lakes, Inc. in these purported class actions against dairy cooperatives on behalf of direct and indirect purchasers of certain products containing raw milk who claim that defendant cooperatives conspired to restrict the supply of raw milk through a common marketing agency. Eimer Stahl has taken an active role in briefing motions to dismiss and opposing class certification in the indirect purchaser case. In addition, it has recently drafted a petition for certiorari to the Supreme Court seeking review of the court's class certification decision. Eimer Stahl has also taken a leading role in defending against direct purchaser claims, successfully obtaining voluntary dismissals of claims by several putative direct purchaser class representatives.
