We represented an insurer in multiple cases alleging the company induced policyholders to buy under-priced "guaranteed renewable" long term care policies, intending to raise rates later. We obtained a dismissal with prejudice in one class case, which was affirmed on appeal. We obtained summary judgment in a second case, and that also was affirmed on appeal. A third case was successfully removed from Louisiana state court, with a motion to dismiss pending when the economical nationwide settlement was reached. We ultimately achieved an economical global settlement of all claims with provisions inhibiting future litigation.
