Eimer Stahl attorneys represented an insurer in a case filed by the State of Louisiana alleging that the company and several other insurers violated antitrust laws by conspiring to underpay people who made property claims after Hurricanes Katrina and Rita. The State of Louisiana argued that the insurer orchestrated this conspiracy to suppress claim payments by recommending estimating software that undervalued labor and materials used to repair or replace damaged homes. The case was dismissed on Twombly grounds.
