Eimer Stahl represented a tool and die manufacturer in a class action brought by residential homeowners against multiple operators in an industrial park.  The complaint alleged property damage as a result of TCE contamination in groundwater.  Defendants successfully moved for summary judgment on plaintiffs’ RCRA count, and thereafter negotiated a modest settlement of the remaining claims.  In addition to defending the company against the underlying litigation, Ms. Hanebutt successfully negotiated with its insurance carriers, resulting in an agreement to fund fully the company’s share of the settlement.
