Eimer Stahl represents LG Electronics, Inc. in multiple lawsuits brought by indirect class purchasers, individual direct purchasers and the State of Florida alleging that defendants violated provisions of United States and state antitrust laws by conspiring to fix prices of optical disk drives.  The cases were consolidated for pretrial proceedings in the U.S. District Court for the Northern District of California before Judge Richard G. Seeborg.  In 2014, Eimer Stahl successfully opposed indirect purchaser plaintiffs’ motion for class certification.  The court found that the indirect purchasers failed to present a model that demonstrated common impact at both the direct and indirect purchaser levels.  See In re Optical Disk Drive Antitrust Litig., 303 F.R.D. 311 (N.D. Cal. 2014).  Eimer Stahl currently is preparing to oppose indirect purchasers’ renewed class certification motion, as well as efforts by the direct purchasers and the State of Florida to advance their cases.
