Caroline Malone represents clients in a wide range of complex commercial disputes in state and federal courts, as well as before major arbitral tribunals. Current representations include defending an international oil refiner in numerous climate change actions and serving on the legal team for a Fortune 100 chemical company in an international arbitration. Though her experience spans a variety of industries, Caroline has a significant focus in the insurance sector, in which she represents some of the nation’s largest insurance providers in breach of contract and fraud cases. Caroline also maintains an active pro bono practice.

During law school, Caroline interned for the Honorable Robert Gettleman of the United States District Court for the Northern District of Illinois and the United States Attorney’s Office in the Northern District of Illinois. She also was in the Criminal and Juvenile Justice Project of the Mandel Legal Aid Clinic, representing clients facing various criminal charges.

COVID-19-Related Business Interruption Litigation (Illinois state and federal courts) – Secured dismissal of numerous class-action lawsuits filed against CNA and its affiliates alleging that insurers breached their insurance policies by failing to pay for lost business income incurred due to COVID-19 induced closure orders.

Confidential Arbitration (American Arbitration Association – International Center for Dispute Resolution 2022) – Trial counsel to Fortune 100 company in breach of contract dispute against major business partner.

National Climate Change Litigation – Defending CITGO Petroleum Corporation in fourteen cases filed across the United States alleging that fossil fuel companies are responsible for various injuries caused by climate change.

Representing a long-term care insurance company in five purported nationwide class actions alleging breach of contract and fraud related to the insurer obtaining rate increases from state insurance regulators on group insurance products.

Confidential Arbitration (London Court of International Arbitration) – Represented refiner in arbitration brought by an Aruban subsidiary of a Venezuelan engineering, procurement, and construction company for alleged breach of contract.

Smith v. Continental Casualty Corp. (U.S. Court of Appeals for the Sixth Circuit) – Defended CNA against a putative consumer class action alleging breach of long-term care insurance contracts.

Beatty v. Accident Fund General Insurance Company et al (United States District Court for the Southern District of Illinois) – Represented client in a class action alleging that workers compensation insurers in Illinois had failed to pay statutory interest for late paid bills.

Pro Bono Representations

Represented National Teachers Academy (NTA) in a lawsuit to stop Chicago Public Schools’ plan to close the top-ranked African American elementary school in Chicago’s South Loop and convert the campus into a high school.

Represented indigent criminal defendant charged with bank fraud, money laundering, and other crimes in a federal jury trial in the U.S. District Court for the District of Columbia.
