Since 1999, Eimer Stahl attorneys have defended a major oil refiner against more than 100 state and federal lawsuits (many of which were consolidated in a federal multidistrict litigation) brought by local and state governments and private water suppliers, alleging that the use of MTBE in gasoline contaminated groundwater and drinking water resources. The complaints assert claims for natural resources damages, market share liability, defective design, failure to warn, private and public nuisance, trespass, and various environmental statutory claims. The MDL has been pending for approximately 15 years and has involved over 100 cases. Eimer Stahl is lead counsel to the refiner and has taken an active leadership role in the joint defense throughout the case.
