Plaintiffs filed a nationwide class action against an insurer on behalf of its long-term care insurance policyholders, challenging claims-handling standards and practices, and alleging fraud and breach of contract.  The plaintiffs also allege that the insurer has engaged in a pattern and practice of refusing to open claims or communicate written claim denials, acted fraudulently in raising its premium rates while reducing the coverage it offered under its policies, and misrepresented the terms of a previous class action settlement.  Eimer Stahl is lead counsel to the insurer.
