At a Thursday afternoon hearing, Judge Robert W. Gettleman issued a temporary restraining order requiring ICE and the Department of Homeland Security to take immediate steps to address conditions at the Broadview facility. The order mandates, among other things, that detainees receive adequate food and water, clean bedding, hygiene items, and necessary medications. It also requires that all detainees have access to legal counsel, including a list of pro bono attorneys provided in both English and Spanish.

“The order issued today is an important step toward addressing the constitutional violations occurring at Broadview. Denying individuals their fundamental rights, including the right to counsel and due process, must never be accepted,” said Nate Eimer, co-counsel with attorneys from the MacArther Justice Center and the ACLU of Illinois. “This ruling is a critical measure to restore basic rights and human dignity to those held at the facility. Immediate action was necessary, and we are grateful for the court’s swift attention to these issues. We hope defendants will act quickly to comply with the order, easing suffering and preventing the dire consequences that occur when detainees’ legal protections are stripped away.”

The order will remain in effect until a status hearing on November 19, 2025.
